Alternative Dispute Resolution - Workplace MediationBy Enda Mc Guane
ADR - Alternative Dispute Resolution is increasingly being used as a timely, cost effective and private way to resolve various work related disputes. At Resolve HR we advocate that all employers in the early stages of any workplace dispute or conflict explore ADR as an option, before resorting to more formal approaches. In Ireland ADR normally consists of Mediation or Conciliation depending on the issue. Typically it involves a neutral third party who attempts to help the parties reach a mutually acceptable agreement. Traditionally Mediation has mainly been used to address issues as part of internal grievance procedures, particularly in relation to Bullying and Harassment. However, in the current economic, with the increased costs of employment litigation and ongoing business restructuring, independent Mediators are now being used to help businesses downsize. Mediation offers businesses a means of agreeing terms and conditions of departure with staff without exposing them to constructive or unfair dismissal claims.
